Who these terms are with

This website is operated by [Legal entity name], trading as Orbiteches, of [Full registered address], Vancouver, British Columbia, Canada. In these terms, "we", "us" and "our" mean that company; "you" means anyone using the site.

By using this website you accept these terms. If you do not accept them, please do not use the site.

Using this site

You may read, print and share the pages of this site for your own business or personal purposes. In return, you agree not to:

  • use the site for any unlawful purpose, or in a way that infringes anyone's rights;
  • attempt to gain unauthorised access to the site, its hosting or any connected system;
  • interfere with the site's operation, including by introducing malicious code or placing an unreasonable load on it;
  • scrape or harvest content systematically for republication, or to train machine-learning models, without our written permission;
  • use the contact form or our email addresses to send unsolicited commercial messages.

Information, not advice

Everything on this site is general information about what we do. It is not professional, technical, financial or legal advice, and it does not take account of your particular circumstances. Do not act on it as though it were a recommendation for your situation — talk to us, or to an appropriate adviser, first.

Figures quoted on this site, including cost reductions and delivery timescales, describe targets and typical outcomes. They are not promises or guarantees of any particular result. What we commit to on a specific project is set out in that project's written proposal.

Intellectual property

The design, text, images, code and structure of this site are owned by us or used with permission, and are protected by copyright and other laws. You may not copy, adapt, republish or exploit them commercially without our written consent.

Third-party names and marks referred to on this site — including Snowflake, Databricks, BigQuery, dbt, Airflow, Power BI, Tableau, Salesforce, Shopify, SAP, Azure and AWS — belong to their respective owners. We name them to describe the technologies we work with. Their use here does not imply any endorsement, partnership or affiliation unless we say so explicitly.

What you send us

When you send us an enquiry, you confirm that the information is accurate and that you are entitled to share it. Please do not send us confidential, sensitive or personal data about third parties through an initial enquiry — if a conversation needs that, we will put a confidentiality agreement and a secure channel in place first.

We handle what you send us as described in our privacy policy.

Third-party links and services

This site may link to websites we do not control, and it loads typefaces from Google Fonts. We are not responsible for the content, availability or privacy practices of any third party. Following an external link is at your own risk.

Availability and changes

We aim to keep the site available, but we do not guarantee uninterrupted access. We may change, suspend or withdraw any part of it at any time, without notice and without liability to you.

No warranties

The site is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, conditions and representations, whether express or implied, including as to accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be error-free, secure or free of harmful components.

Some jurisdictions do not allow the exclusion of certain warranties. Where that is the case, the exclusions above apply only to the extent the law permits, and nothing in these terms affects consumer rights that cannot lawfully be excluded.

Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss, or for loss of profits, revenue, data, goodwill or business opportunity, arising from your use of — or inability to use — this site.

Where our liability cannot be excluded, it is limited to CAD 100. Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.

Engagements are separate

These terms cover the website only. Any work we do for you — audits, platform builds, managed analytics or anything else — is governed by a separate written agreement covering scope, price, timelines, confidentiality, intellectual property and liability. Where that agreement and this page differ, that agreement prevails.

Nothing on this site is an offer capable of acceptance, and submitting an enquiry does not create a contract or a client relationship between us.

Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have exclusive jurisdiction, except that we may bring proceedings to protect our intellectual property in any competent court. If you use the site from elsewhere, you are responsible for complying with your local law.

If any provision of these terms is found unenforceable, the rest continues in force.

Changes to these terms

We may revise these terms from time to time. The version published here is the one that applies, and the effective date at the top tells you when it was last changed. Continuing to use the site after a change means you accept the revised terms.
